Privacy Policy
1. Preamble
Cabinet ExpertImmo is formally committed to protecting the personal data of its clients and contacts in accordance with Law No. 2014-038 of 9 January 2015 on the protection of personal data in the Republic of Madagascar, as well as its implementing decree No. 2023-1541. The supervisory authority responsible for the enforcement of these provisions is the Malagasy Commission for Information Technology and Civil Liberties (CMIL — Commission Malagasy de l'Informatique et des Libertés).
In this policy, the Court-Accredited Expert in Buildings and Real Estate Property near the Courts and Tribunals of Madagascar, member of CAREA (Compagnie des Arbitres Rapporteurs et Experts Agréés près les Cours et Tribunaux de Madagascar — Madagascar's official body of court-accredited arbitrators, rapporteurs and experts), is hereinafter referred to as "the Expert".

In the course of our exchanges, we may collect certain information concerning you.
Through the website's contact form:
- Full name
- Email address
- Phone number
- Reason for the request (category of appraisal)
- Free-text description of the property and context
Through subsequent email or telephone exchanges:
- Supporting documents, title deeds, or any information relating to the property being appraised that is necessary for the performance of our engagement.
4. Purposes of Processing
The processing of personal data by Cabinet ExpertImmo pursues exclusively the following purposes:
- Responding to contact requests and correspondence.
- Issuing quotations and fee agreements prior to engagements.
- Carrying out, with full rigour, appraisal engagements (judicial or amicable).
- Maintaining the professional records required by CAREA's code of conduct.
- Complying with our legal, accounting and tax obligations.
Important: We do not use your data for any commercial or advertising purpose, nor do we resell it to third parties. Your data is not subject to any profiling or automated decision-making.
5. Legal Basis of Processing
In accordance with the provisions of Law No. 2014-038 (in particular Articles 6 to 13), the processing of your data is lawful and based on the following grounds:
- The consent of the data subject, expressly obtained when submitting the contact form.
- The performance of a contract, in connection with the signing of an appraisal agreement or pre-contractual measures.
- Compliance with a legal obligation to which the firm is subject (record-keeping, archiving of judicial reports, tax obligations).
- The legitimate interest of the data controller in the administrative management and proper operation of the firm.
6. Recipients
The data collected is strictly intended for the following recipients:
- The staff of Cabinet ExpertImmo: Mr. RABENIMANANA Normand alone, or, where applicable, internal personnel specifically authorised and bound by a duty of confidentiality.
- The competent courts: Strictly within the exclusive scope of judicial engagements entrusted to us by court order or judgment.
- Specialist consulting experts (experts sapiteurs): Where appointed by the magistrate during an engagement for additional technical opinion.
- Our technical providers: In particular the website host, acting under contracts containing strict confidentiality clauses.
No personal data is transmitted to third parties for commercial purposes, to advertising partners, or to marketing platforms.
7. Retention Period
Your data is retained for periods strictly proportionate to the purposes set out above:
- Contact requests without follow-up: Retained for a maximum period of 12 months.
- Files of completed engagements (amicable appraisals): Retained for the legal period applicable to professional archives, namely at least 10 years from the closure of the file.
- Judicial appraisal reports: Retained in strict compliance with the filing and archiving obligations imposed on the Expert.
8. Confidentiality and Professional Secrecy
Independently of the obligations arising from personal data protection legislation, the Expert is bound by the strictest professional secrecy, in accordance with the ethical rules governing the profession. This secrecy covers all information, correspondence, documents and findings relating to a file, an appraised property or a client, and may only be lifted in cases expressly provided for by law or by decision of the competent court.
9. Security
Cabinet ExpertImmo has implemented the technical and organisational measures necessary to preserve the integrity and confidentiality of your data. These measures include in particular:
- Encryption of communications on the website through the HTTPS/TLS protocol.
- Implementation of HTTP security headers (such as HSTS, CSP) to prevent cyberattacks.
- Secure local storage of the firm's digital and physical archives.
- Strictly controlled physical access to the professional premises.
10. Rights of Data Subjects
In accordance with the provisions of Law No. 2014-038, any data subject is entitled, at any time, to the following rights over their data:
- Right to be informed.
- Right of direct or indirect access to your data.
- Right to rectification of inaccurate or incomplete information.
- Right to object to processing on legitimate grounds.
- Right to erasure (this right is exercised strictly within the limits of professional secrecy and the mandatory legal retention obligations imposed on the Expert).
How to exercise these rights: To exercise these rights, you may submit a written request, accompanied by proof of identity:

The firm undertakes to provide you with a response within a maximum period of 30 days.
11. Complaint to the CMIL
If, after having contacted us, you consider that the processing of your data does not comply with the provisions of Law No. 2014-038, you have the right to lodge a formal complaint with the competent supervisory authority: the Malagasy Commission for Information Technology and Civil Liberties (CMIL).
12. Cookies
Our philosophy is to minimise the collection of information. The website does not use any tracking, profiling or advertising cookies. Only technical cookies strictly necessary for the operation of the website or for storing your language preferences may be placed on your device. These cookies do not require prior consent.
13. Modifications to this Policy
Cabinet ExpertImmo reserves the right to adapt and modify this privacy policy from time to time, in particular to comply with legislative, regulatory or case-law developments. The applicable version is always the one in force and published on the website on the date of your consultation.
14. Effective Date
This privacy policy has been in effect since 10 May 2026.
